Welcome to Calculus Starships! These Terms of Service ("Terms") govern your use of the website calculusanimated.com (the "Site") and the services, features, content, applications, or products offered by Calculus Starships ("Calculus Starships," "we," "us," or "our").

1. Agreement to Terms

By accessing or using our Site and Services (as defined below), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you may not access or use the Site or Services. We may modify these Terms at any time, and such modifications shall be effective immediately upon posting the modified Terms on the Site. You agree to review the Terms periodically to be aware of such modifications, and your continued access or use of the Site shall be deemed your conclusive acceptance of the modified Terms.

2. Definitions

  • "Site" refers to the website located at calculusanimated.com.
  • "Services" refers to the educational video animations, explanations, related content, and any other features or functionalities offered through the Site.
  • "Content" means all text, graphics, images, music, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided, or otherwise made available through the Services.
  • "User," "you," or "your" means any person who accesses or uses the Site or Services.
  • "Product" refers to the specific package or access level purchased via the one-time payment, granting access to designated Calculus Starships Content and Services.

3. Access and Use License

Subject to your compliance with these Terms, Calculus Starships grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and the specific Content included in the Product you purchased, solely for your personal, non-commercial, educational purposes.

4. User Obligations and Conduct

  • You agree to use the Site and Services only for lawful purposes.
  • You are responsible for maintaining the confidentiality of any account information (if applicable) and are fully responsible for all activities that occur under your account.
  • You agree not to share your access credentials or allow others to use your access to the Product. Access is granted to the individual purchaser only.
  • You agree not to copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of Calculus Starships or the respective licensors of the Content.
  • You agree not to interfere with or disrupt the Site or Services or servers or networks connected to the Site or Services.
  • You agree to provide accurate and complete information when requested, particularly for payment and refund processing.

5. Payment

Access to the premium Content and Services offered as the Product on Calculus Starships requires a one-time payment. The specific content included in the Product and the price will be clearly stated on the Site at the point of purchase.

  • Payment Processing: Payments are processed through a third-party payment processor (e.g., Stripe, PayPal). You agree to provide accurate payment information and authorize us (through our processor) to charge your chosen payment method for the total amount of your purchase. We do not store your full credit card information on our servers. You are subject to the terms and conditions of the third-party payment processor.
  • Taxes: You are responsible for any applicable taxes associated with your purchase.
  • Access Grant: Upon successful completion of the one-time payment, you will be granted access to the specific Product purchased according to the terms described at the time of purchase (e.g., lifetime access to specified content).

6. Refund Policy - 30-Day Satisfaction Guarantee

We offer a conditional 30-day refund policy on the one-time payment for the Product. To be eligible for a refund, you must meet the following criteria:

  • You must request the refund within 30 calendar days of your original purchase date by contacting us at info@calculusanimated.com.
  • You must satisfy ONE of the following two conditions:
Condition A (Lack of Grade Improvement): You must provide verifiable evidence demonstrating that your grade in the relevant calculus course did not improve after utilizing the Calculus Starships videos included in the Product. This requires submitting clear screenshots or copies of:
  • A graded test or significant assignment prior to extensively using the purchased Calculus Starships content.
  • A graded test or significant assignment of comparable scope/topic after having reasonably engaged with the purchased Calculus Starships content.

Both submissions must clearly show the grade, relevant dates (demonstrating the before/after timeline relative to your purchase date), and course context. Calculus Starships reserves the right to evaluate the submitted evidence for relevance and authenticity.

Condition B (Preference for Competitor): If your dissatisfaction stems from the teaching style, explanation quality, or content presentation, you must:
  • Identify a specific, comparable online lecture or video resource from a direct competitor (e.g., another calculus tutorial website or platform).
  • Provide a direct link to the competitor's specific resource.
  • Provide a detailed written explanation comparing the Calculus Starships content you are dissatisfied with and the competitor's resource, specifically outlining why you find the competitor's resource superior for your learning needs. The comparison must be substantive and specific. Calculus Starships reserves the right to evaluate the validity and specificity of the comparison.
  • Process: Contact info@calculusanimated.com with your refund request, stating clearly which condition (A or B) you are fulfilling and providing the required documentation/explanation as outlined above.
  • Evaluation: We will review your submission based on the conditions stated. We reserve the right to deny refund requests that do not strictly meet one of the conditions or where the provided evidence/explanation is deemed insufficient, unclear, or unverifiable.
  • Issuance: If your request is approved, the refund will typically be processed within 7-10 business days to the original payment method used for the purchase.
  • Finality: Only one refund request per purchase is permitted. Failure to meet the requirements within the 30-day window or failure to satisfy either Condition A or Condition B will result in the denial of the refund request.

7. Intellectual Property Rights

All Content on the Site and included in the Services and Product is the property of Calculus Starships or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. You acknowledge that you do not acquire any ownership rights by using the Site or purchasing the Product, other than the limited license granted herein.

8. Disclaimers

THE SITE, SERVICES, CONTENT, AND PRODUCT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WHILE WE STRIVE TO PROVIDE HIGH-QUALITY EDUCATIONAL CONTENT, CALCULUS STARSHIPS DOES NOT WARRANT THAT THE CONTENT IS ACCURATE, COMPLETE, RELIABLE, CURRENT, OR ERROR-FREE.

CALCULUS STARSHIPS DOES NOT GUARANTEE ANY SPECIFIC ACADEMIC OUTCOME, GRADE IMPROVEMENT, OR SUCCESS IN ANY COURSE OR EXAMINATION AS A RESULT OF USING THE SITE, SERVICES, OR PRODUCT. Your academic success depends on various factors, including your effort, study habits, course structure, and instructor. The refund policy condition related to grades (Condition A) is a measure of satisfaction based on provided evidence, not a guarantee of grade improvement.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CALCULUS STARSHIPS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SITE, SERVICES, OR PRODUCT.

UNDER NO CIRCUMSTANCES WILL CALCULUS STARSHIPS'S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR FROM THE USE OF OR INABILITY TO USE THE SITE, SERVICES, OR PRODUCT EXCEED THE AMOUNT YOU HAVE PAID TO CALCULUS STARSHIPS FOR USE OF THE PRODUCT.

10. Indemnification

You agree to defend, indemnify, and hold harmless Calculus Starships, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with (i) your access to or use of the Site, Services, or Content, (ii) your violation of these Terms, or (iii) your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right.

11. Termination

We may terminate or suspend your access to the Site and Services, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease. Provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts for any actions for which we retain the right to seek injunctive or other equitable relief.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting on the Site or via email. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
